"All NSF grantees must comply with these executive orders… by ceasing all… grant activity that uses or promotes… diversity, equity, inclusion and accessibility (DEIA) principles and frameworks" new.nsf.gov/executive-orders
-
This advice has been sent to National Science Foundation grant recipient researchers [Principal Investigators] as of today.

NSF announcement today: new.nsf.gov/executive-orders
-
(I'm not a lawyer, but…) this executive order runs directly counter to numerous statutes authorizing and governing the NSF, which are helpfully listed here: uscode.house.gov/view.xhtml?req=(title:42%20section:1861%20edition:prelim)
-
The National Science Foundation must also comply with its authorizing laws, which are quite clear about promoting the inclusion of women, minorities, and people with disabilities.
-
For instance the 1980 Science & Technology Equal Opportunities Act: "Congress declares that the highest quality science over the long-term requires substantial support, from currently available research and educational funds, for increased participation by women and minorities."
-
Or the 2010/11 America COMPETES act, directing the NSF to consider diversity as a goal in evaluating every grant: "apply a Broader Impacts Review Criterion to achieve the following goals: … Increased participation of women and underrepresented minorities in STEM."
-
The NSF is required by statute to have a Chief Diversity Officer and that staffer must support diversity in higher ed, K-12, and scientific recruiting. govinfo.gov/app/details/USCODE-2023-title42/USCODE-2023-title42-chap163-subchapIII-partC-sec19015
