      Áñez is on trial for the irregular assumption of the presidency. The lack of security protection provided to those constitutionally designated as successors, Borda and Salvatierra, is a core issue in the trial.

      Anyone aware of Borda's resignation knows how it happened. Borda's statement: "I renounce the [presidency of the] Chamber of Deputies; … may God grant that this will preserve the physical integrity of my brother who has been taken hostage."

        (Under the Bolivian Constitution, the legislative assembly must meet to consider such resignations, which arguably have to be submitted in writing. Áñez convened a session without quorum to proclaim Borda and Salvatierra to have abandoned their offices.
